These Terms of Use (the "Terms") govern the rights, obligations, and responsibilities between Nook Company (the "Company") and users in connection with the use of the Dolca service and all related services (the "Service") provided by the Company.
The terms used in these Terms are defined as follows.
The Company shall post these Terms within the Service so that Users can review them. The Company may amend these Terms to the extent that it does not violate applicable laws. When amending the Terms, the Company shall specify the effective date and the reason for the amendment and give notice within the Service or by other means prior to the effective date. For amendments unfavorable to Users, the Company shall give notice with a grace period of at least 30 days. A User who does not agree to the amended Terms may terminate the use contract; if a User continues to use the Service after the notified effective date, the User is deemed to have agreed to the amended Terms.
The Company provides the following services.
The Company may modify or discontinue all or part of the Service being provided as required by the substance of the Service or by operational or technical needs, and in such cases shall, where possible, give advance notice of the reason and details.
The use contract is formed when a User agrees to these Terms and creates an account through an external authentication method. The Service is intended for adults, and Users must be 19 years of age or older. Minors may not use the Service, and the Company may restrict use or terminate the contract if it confirms that a User does not meet the age requirement.
Users must not engage in any of the following acts.
The Company provides certain features for a fee, and Users may use them by purchasing Credits or by paying for a Subscription. All payments are processed in accordance with the in-app purchase policies of the app marketplaces (Google Play, App Store, etc.), and the price of each product is the amount displayed in the app marketplace and within the Service at the time of purchase.
1. Credits. Credits are consumable items used to access paid features within the Service and are added to a User's account upon purchase. Credits are not refundable in cash, and a validity period and usage conditions determined by the Company may apply.
2. Subscription product. The Company offers an auto-renewing subscription product, "Unlimited Chat" (the "Subscription"). The Subscription is billed on a monthly basis, and while it is active, no Credits are deducted when the User converses with an AI character. If paid features other than conversation are introduced, those features may require Credits separately, and the Company will give notice within the Service. The Subscription does not include a free trial period; paid use begins from the initial payment.
3. Automatic renewal. Unless the User cancels, the Subscription renews automatically for the same period at the end of each billing cycle, and the renewal fee is charged to the payment method registered with the User's app marketplace account within 24 hours before the end of the current billing cycle. A User who does not wish the Subscription to renew must cancel it at least 24 hours before the end of the current billing cycle.
4. Cancellation. A User may cancel the Subscription at any time from the subscription management screen of their app marketplace account (for example, Google Play → Payments & subscriptions → Subscriptions). Cancellation does not end access immediately: the benefits of the Subscription remain available for the remainder of the billing cycle that has already been paid for, and no prorated refund is given for that remaining period. Withdrawing membership within the Service does not cancel the Subscription with the app marketplace; a User must therefore cancel the Subscription separately in the app marketplace before withdrawing.
5. Price changes. If the Company changes the Subscription fee, it will give notice before the renewal date in accordance with the app marketplace's policies, and a User who does not agree to the changed fee may cancel the Subscription before that renewal date.
Cancellation (withdrawal of offer) and refunds for paid purchases are subject to applicable laws, including the Act on the Consumer Protection in Electronic Commerce, etc. (Republic of Korea), and to the refund policies of the relevant app marketplace. However, for Credits already used or Content whose value has significantly diminished through use, refunds may be limited to the extent permitted by applicable laws.
Payments and refunds for the Subscription are handled directly by the app marketplace, so a User seeking a refund must request it through the procedures established by that marketplace. Cancelling the Subscription only stops future automatic renewals and does not by itself entitle the User to a refund of amounts already paid; for billing periods that have already elapsed and services used during those periods, refunds may be limited to the extent permitted by applicable laws.
Intellectual property rights, including copyrights, in the Service and in the characters and content provided by the Company belong to the Company or its rightful holders. Users may not, without the Company's prior consent, reproduce, distribute, transmit, or display such material, or create derivative works, or otherwise use it without authorization, whether for commercial or non-commercial purposes. Rights in the Content that a User inputs into the Service belong to the User; however, the Company may use such Content to the extent necessary to provide, operate, and improve the Service (including quality improvement and safety review).
To operate the Service safely and comply with applicable laws, the Company may restrict or delete content that is inappropriate or in violation of its policies, and may, where necessary, review conversation content for the purposes of handling reports and conducting policy review. In such cases, access is limited to the minimum necessary scope, and the related records are retained.
If a User violates these Terms or applicable laws, the Company may suspend use of the Service or terminate the use contract after prior notice (or after-the-fact notice in urgent cases). A User may terminate the use contract at any time through the withdrawal function within the Service; upon withdrawal, the User's data will be deleted in accordance with applicable laws and the Privacy Policy.
While Dolca aims to provide comfort and emotional companionship, it is not a professional mental health service and is not a means of emergency response to crisis situations. The Company protects Users' personal information in accordance with applicable laws. Details regarding the collection, use, storage, and destruction of personal information are set out in a separate Privacy Policy.
The laws of the Republic of Korea govern any dispute arising between the Company and a User in connection with these Terms and the use of the Service. Disputes shall, in principle, be resolved through mutual consultation; if no agreement is reached, they shall be handled in accordance with the procedures and the competent court provided by applicable laws.
